These terms govern your use of the 55plus.community website. Please read them before using the site.

1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and 55plus.community ("we", "us", "our"), which operates 55plus.community (the "Site").
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Who may use the Site
You must be at least 18 years old and able to form a binding contract to use the Site. You agree to use it only for lawful purposes and in accordance with these Terms.
3. What the Site is — and what it is not
The Site is an informational search and discovery tool. It aggregates and displays information about active-adult communities, age-restricted housing and senior-friendly homes so that you can research options.
To be explicit about what we are not:
- We are not a real estate broker or agent, and we do not act as one for you or anyone else. We do not list, market, sell, rent or manage property.
- We are not a party to any transaction. Any purchase, rental, application, deposit or agreement is strictly between you and the community, seller, landlord, builder or their representatives.
- We do not provide legal, financial, tax, investment, medical or care advice. Nothing on the Site is a substitute for professional advice about your circumstances.
- We do not represent or endorse any community, property, builder, agent or third party appearing on the Site.
4. Listing information and accuracy
Property and community information on the Site is aggregated from third-party real estate data sources and public listing feeds. We work to keep it current, but listing data changes constantly and may be delayed, incomplete, outdated or incorrect.
In particular, prices, availability, property status, fees, taxes, square footage, bedroom and bathroom counts, images, amenities, and age-eligibility rules may be inaccurate or out of date. Property images are supplied by third-party sources and remain the property of their respective owners.
You must independently verify any information that matters to your decision, directly with the community, the listing agent, or the seller, before relying on it. We do not warrant the accuracy, completeness, or availability of any listing.
5. Fair housing and age-restricted communities
Equal Housing Opportunity. We support the principles of the U.S. Fair Housing Act. Housing described on the Site as "55+", "age-restricted" or "active adult" is offered by communities operating under the Housing for Older Persons Act (HOPA) exemption.
Age eligibility, occupancy limits and community rules are set, verified and enforced by each individual community — not by us. Whether you qualify for a particular community is a question for that community. We make no housing decisions and do not screen, qualify or refuse any person.
6. Acceptable use
You agree not to:
- Scrape, crawl, harvest, or use automated means to extract data from the Site, or access it other than through the interfaces we provide;
- Copy, republish, resell or redistribute listing data or other Site content without our written permission;
- Attempt to gain unauthorised access to the Site, our servers, or any connected system, or probe or test their security;
- Interfere with or disrupt the Site, including by overloading it or introducing malicious code;
- Use the Site to harass, defraud, or mislead any person, or in violation of any applicable law, including fair housing law;
- Misrepresent your identity or affiliation, or remove any proprietary notice from Site content.
We may suspend or block access to anyone we reasonably believe is breaching these rules.
7. Enquiries and communications
If you contact us, you consent to us replying to you at the address or number you provide. If we pass an enquiry to a community or agent at your request, we do so as a convenience and not as your representative; we are not responsible for how that party handles your enquiry or what they tell you.
8. Intellectual property
The Site itself — its design, layout, text, graphics, logos and software — is owned by us or our licensors and is protected by intellectual property law. Third-party listing data and images remain the property of their respective owners and are displayed under the terms on which we receive them.
You may view and print pages for your own personal, non-commercial research. All other rights are reserved.
9. Third-party links
The Site links to third-party websites, including listing sources and community sites. We do not control those sites, are not responsible for their content, accuracy, or practices, and their inclusion is not an endorsement. Your use of a third-party site is governed by that site's own terms and privacy policy.
10. Availability
We aim to keep the Site available but do not guarantee uninterrupted access. We may modify, suspend or discontinue any part of the Site, including specific listings or features, at any time and without notice.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Site and all content on it are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, reliability, timeliness or completeness of listing information.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Site — including any decision you make, or fail to make, in reliance on information found here.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed USD 100.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability for fraud, wilful misconduct, or death or personal injury caused by negligence.
13. Indemnity
You agree to indemnify and hold harmless 55plus.community and its officers, employees and agents from any claim, liability, loss or expense (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of Maharashtra, India, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in Maharashtra, India for any dispute arising out of or relating to these Terms or the Site.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be highlighted on this page. Your continued use of the Site after a change takes effect means you accept the revised Terms.
16. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
